The petitioner contends that his pension amount has been incorrectly calculated and is liable to be recomputed. He has made a representation in this regard but to no avail. The only prayer made by Shri Shivam Yadav, learned counsel for the petitioner is that his representation may be decided within a stipulated period of time. Shri Gaurang Tiwari, learned counsel holding brief of Shri Tejashvi Mishra, learned counsel for the respondent submits that the determination of correct pension amount is a matter of fact which has to be decided as per applicable law by the competent authority. He, however, fairly submits that the claim of the petitioner is liable to be decided in a reasonable period of time. In light of the aforesaid submissions and without going into the merits of the case, the respondent no. 2 is directed to decide the representation of the petitioner for correct calculation of pension amount within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of.
