1. This matter is taken up through hybrid mode.
2. Petitioner in this writ petition seeks to assail the notice dated 01st May, 2017 (Annexure-7) and 13th September, 2017 (Annexure- 9) issued by the Odisha Waqf Board to hand over the property to the Waqf Board.
3. In course of hearing, Mr. Pronoy Mohanty, learned counsel for the Petitioner by filing a memo, prays for withdrawal of this writ petition submitting that the Petitioner has a remedy under Section 83(u) of the Waqf Act to move the Waqf Tribunal for redressal of his grievance. The memo so filed, is taken on record.
4. Mr. K.M.H. Niamati, learned counsel appearing for the Odisha Waqf Board does not have any objection to the same.
5. In view submission made, the Writ Petition is disposed of as withdrawn with an observation that the Petitioner if so advised, may move the Waqf Tribunal in accordance with law for redressal of his grievance
