JUSTICE PRADEEP SINGH YERUR ORAL JUDGMENT This is an appeal preferred by the plaintiff, aggrieved by the judgment and decree dated 25.01.2022 passed in O.S.No.245/1995 by IV Additional I Civil Judge (Jr.Dn.), Mysuru dismissing the suit of the plaintiff, which is affirmed by the judgment and decree dated 17.1.2011 passed in R.A.No.69/2002 by the Judge, Court of Small Causes, Mysuru. - 3 - HC-KAR NC: 2025:KHC:39107 RSA No. 294 of 2012 2. During pendency of these proceedings, the parties have amicably entered into a settlement and have put the same in writing by way of compromise petition, wherein the terms and conditions are enumerated in para-6(i) to (iv). 3. The appellant, Smt.Vedavathi T. - the Assistant General Manager of K.S.S.I.D.C. Limited-respondent Nos.1 and 2, Mysuru Division and respondent No.3 are physically present before the Court. 4. The parties have been enquired by this Court with regard to the terms and conditions of the compromise petition entered into by them today and filed in the Open Court. All the parties agreed to the terms and conditions of the compromise petition entered into by them and they submit that there is no force, coercion, ill-will in executing this compromise petition and they have signed the same out of their own will and volition, without any force or coercion. - 4 - HC-KAR NC: 2025:KHC:39107 RSA No. 294 of 2012 5. Under the circumstances, the compromise petition is appended with the documents viz., letter from KSSIDC dated 17.11.2023, deed of partition dated 12.03.2024, another letter from KSSIDC dated 02.07.2024, lease-cum- sale agreement approved by KSSIDC dated 04.10.2024 and letter from JS Associates to KSSIDC dated 04.10.2024 along with the joint affidavit filed by appellant and respondent No.3-private party. The same are placed on record. 6. In view of the settlement agreed by way of compromise petition between the parties, the appeal will have to be disposed of in terms of the compromise petition. It is also agreed that the parties will abide by the terms and conditions of the compromise petition. Accordingly, I pass the following: ORDER i) This Regular Second Appeal stands disposed of in terms of the compromise petition; - 5 - HC-KAR NC: 2025:KHC:39107 RSA No. 294 of 2012 ii) The judgment and decree dated 25.01.2022 passed in O.S.No.245/1995 by IV Additional I Civil Judge (Jr.Dn.), Mysuru and the judgment and decree dated 17.1.2011 passed in R.A.No.69/2002 by the Judge, Court of Small Causes, Mysuru stands modified to the extent of the terms and conditions of the compromise petition entered into by the parties herein; iii) Registry is directed to draw the decree as per the terms set out in the compromise petition.
