At the outset, learned counsel for the applicant would submit that this Revision may be disposed of with liberty to the applicant to raise all the grounds before the trial Court as no proper preliminary issue has been framed. Further, the applicant may also also be granted liberty to file an appropriate application under Order 14 Rule 5 of the CPC before the trial Court. 4. In view of the above, the Revision is disposed of with the liberty prayed for. 5.
