JUSTICE RAJESH MAZUMDAR ORDER Date : 12.09.2026 The connected I.A.(Civil) No. 845/2025 praying for condnation of delay in preferring the appeal remains to be allowed. It has been submitted by Ms. Hena Haflongbar representative of New India Assurance Company that during the pendency of the Interlocutory Application, the appellant New India Assurance Company Limited and the claimants namely, Mrs. Manisha Sharma, Mrs Madhuri Devi, Miss Darshana Kashyap Sharma have entered into a settlement at a consolidated amount of Rs.15,90,000/- inclusive of the interest against the award of Rs.16,17,000/- given by the learned Tribunal. Since the parties have come to a settlement regarding the claim, the MAC Page No.# 3/3 Appeal connected to the Interlocutory Application need not be processed any further. The said amount shall be disbursed to the claimants, in the same proportion as per the terms of the award passed by the learned Tribunal. Since the parties have arrived at a settlement, the Interlocutory Application for condonation of delay in preferring the connected appeal and the MAC Appeal will stand closed. The copy of settlement be kept on record. The statutory deposit by the Insurance Company be refunded.
