PUBLIC PROSECUTOR (AP) 2 Crl.A.No.3329 of 2018 The Court made the following JUDGMENT :- (Per the Hon’ble Sri Justice K.Suresh Reddy) Questioning the conviction and sentence passed by the learned IV Additional District and Sessions Judge, Nellore, dated 12.02.2018 in S.C.No.53 of 2017, the sole accused filed the present Criminal Appeal under Section 374(2) of Code of Criminal Procedure, 1973. 2. During pendency of the appeal, the appellant was granted bail by this Court, vide order dated 01.03.2023, in terms of the order dated 02.11.2016 passed by the Combined High Court in Batchu Rangarao and others Vs The State of Andhra Pradesh (Crl.A.M.P.No.1687 of 2016 in Crl.A.No.607 of 2011). While so, learned Principal District and Sessions Judge, Nellore has addressed a letter, dated 30.01.2025 to the Registrar (Judicial) stating that after granting bail, the appellant met with an accident and succumbed to injuries on 04.08.2024, which was the subject matter of Crime No.101 of 2024 of T.P.Gudur Police Station. A copy of the FIR was also annexed by the learned Principal District and Sessions Judge, Nellore along with the letter. 3. Whereas, the learned Additional Public Prosecutor while confirming the factum of the death of the appellant has filed a memo signed by the Sub Inspector of Police, T.P.Gudur Police Station 3 Crl.A.No.3329 of 2018 wherein it was stated that the appellant met with an accident and died on 04.08.2024. 4. In that view of the matter and in view of the death of the appellant, the Criminal Appeal is liable to be dismissed. 5. Accordingly, the Criminal Appeal is dismissed as “abated”. Consequently, miscellaneous petitions, if any, pending shall stand closed.
