1. Learned counsel for the petitioner would submit that both the parties have entered into compromise to settle their dispute outside the Court and the same has been settled which is evident from the letter dated 19.10.2023 of the respondent which is received by the Registry of this
2 Court on 31.10.2023. In this letter, the respondent has clarified that due to weakness he is unable to mark his appearance in person before this Court. In this view of the matter, learned counsel for the petitioner submits that he may be permitted to withdraw this appeal.
