2. The petitioner has been made accused in connection with Bariyatu P.S. Case No. 71/2024, for the offences registered under Section 111(4) of the B.N.S. and Section 25(1-B) (A), 26/35 of the Arms Act, pending in the Court of Mrs. Swati Vijay Upadhyay, learned J.M., 1st Class, Latehar.

On 17.11.2024, at about 10:10 p.m., Bariyatu Police, on the basis of confidential information that unknown persons had assembled near a Mahua Tree in Golitand Jungle and were making a preparation for committing dacoity, raided the place of occurrence and apprehended the accused persons including the petitioner. On search, arms and ammunitions were recovered from the accused persons.

Learned counsel appearing on behalf of the petitioner has submitted that only a mobile phone has been recovered from the possession of the petitioner.
5. Mr. Rakesh Ranjan, learned A.P.P. has opposed the prayer for bail.
6. Considering the fact that no firearm was recovered from the possession of the petitioner, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Mrs. Swati Vijay Upadhyay, learned J.M., 1st Class, Latehar in connection with Bariyatu P.S. Case No. 71/2024.
