HON'BLE MR. JUSTICE SANJEET PUROHIT
Order 03/11/2025 The present application has been filed for recalling of the
order dated 31.07.2025 passed by this Court, whereby the writ petition was disposed of in terms of the judgment dated 30.07.2025 passed in S.B. Civil Writ Petition No.6926/2025 (Chandra Prakash Meena v. State of Rajasthan & Ors.).
Learned counsel for the petitioner submits that as a matter of fact, the writ petition is involving completely distinct issue, however, the same was decided by this Court observing the issue
[2025:RJ-JP:44042] (2 of 2) [WMAP-358/2025] involved in the writ petition is squarely covered by the judgment passed in case of Chandra Prakash Meena (supra), whereas the issue involved in that case, was with regard to the maintainability of the writ petition on behalf of the Administrator, who has been restrained from operating the bank accounts of Gram Panchayat. This court has perused the pleadings as well as prayer made in the present writ petition, which is relating to the de-limitation notification issued by the respondent authorities. In this view of the matter, it is found that the issue involved in the present writ petition is distinct from the issue involved in the case of Chandra Prakash Meena (supra) and therefore, the writ petition requires independent adjudication. For the reasons stated & grounds mentioned, the present application is allowed. The order dated 31.07.2025 passed by this Court is recalled. Office is directed to restore S.B. Civil Writ Petition No.11472/2025 on its original number and the same be placed for
consideration before the appropriate Bench.
