It is the contention of the petitioner that his uncle, Late Sri Thipparaju was conferred occupancy rights under Section 10 of the Mysore (Personal and Miscellaneous) Inams Abolition Act, 1954, by order of the Land Tribunal on 25.11.1975 in case No.391/1974-75. The name of Sri Thipparaju was entered in the revenue records. However, after computerization, the name of Sri Thipparaju was not continued in the RTC. Therefore, during his lifetime, Sri Thipparaju had approached the revenue authorities seeking the continuation of his name in the revenue records. No orders were passed by the

HC-KAR NC: 2025:KHC:33149 WP No. 14813 of 2025 revenue authorities. However, Sri Thipparaju died on 23.06.2023 leaving behind a Will bequeathing the property in question in favour of the petitioner. The prayer in the writ petition is to issue a writ of mandamus directing the respondents-authorities to consider the representation given by the petitioner who seeks his name to be entered in the revenue records.

The writ petition stands disposed of with a direction to the second respondent-Tahsildar, Bangalore South Taluk, to verify from the records as to whether the name of Sri Thipparaju was entered in the revenue records pursuant to the order said to have been passed by the Land Tribunal. If that is so, then the name of Sri Thipparaju shall be initially entered in the revenue records. Thereafter, notice shall be issued to all the concerned relating to Sri Thipparaju for entering the name of the petitioner in the revenue records based on the Will. If there are no objections from any quarters, then the name of the petitioner can be entered while mutating the

HC-KAR NC: 2025:KHC:33149 WP No. 14813 of 2025 name of Sri Thipparaju in the revenue records. On the contrary, if there are any objections, the petitioner may be directed to approach a competent Civil Court to get a declaration regarding the Will left behind by Sri Thipparaju.
4. The entire exercise shall be completed as expeditiously as possible and at any rate, within a period of three months from the date of receipt of a copy of this
