ORAL ORDER
This petition is filed under Section 482 of BNS praying to grant anticipatory bail in C.C.No.50984/2016 (Crime No.247/2014 of Byappanahalli Police Station) registered for the offence under Section 120-B, 420, 471 read with 34 IPC, pending on the file of X Additional Chief Judicial Magistrate, Bengaluru. 2. Heard learned counsel for petitioner and learned Additional SPP for respondent/State. 3. Learned counsel for petitioner would contend that the petitioner was working under accused No.1 in his company. The main allegation of cheating is on accused No.1. The petitioner has not received any summons or warrants and he was not aware of registration of the case and filing of the charge sheet. The petitioner undertakes to

appear before the trial Court and co-operate for speedy disposal of the case. There are no criminal antecedents of the petitioner. With this, he prayed to allow the petition. 4. Per contra, learned Additional SPP would contend that the case is registered against the petitioner in the year 2014 and charge sheet has been filed and it is pending in CC No.50984/2014. The petitioner has not appeared in the said case and therefore, the Court has issued proclamation. Therefore, the petitioner is not entitled for grant of anticipatory bail. With this she prayed to reject the petition. 5. Having heard the learned counsels, the Court has perused FIR, complaint and other materials placed on record. 6. On perusal of the charge sheet, the case of the prosecution is that accused Nos. 1 to 3 were residing in a rented house in Malleshapalya in Bangalore and conspired together and a company which is not registered, by name

KML Group of Industries, got introduced CW1, CW4, CW5 and CW6 stating that they will be shareholders in the Company and will get share in the profit. Accused No.1 in his name has shown fake documents for having FD and shares in SBM Bank and got gold ornaments from CW1 to 5 and kept them and availed loan in his name and cheated them. There is no serious overt act alleged against this petitioner except the conspiracy with the other accused. The petitioner is stated to be residing in Rama Krishnapuram, Krishnagiri, Kurnool District, State of Andhra Pradesh.
It is submitted that the petitioner has not received any summons or warrants. Now the petitioner apprehends his arrest as proclamation has been issued against him. The petitioner has undertaken to appear in the criminal case and co-operate for speedy disposal of the case and abide by any conditions to be imposed by this Court. There are no criminal antecedents of the petitioner. - 5 -

7. Considering the above aspects, the petitioner has made out case for grant of anticipatory bail with conditions. In the result, the following:
ORDER
The petition is allowed. The petitioner is ordered to be released on bail, in the event of his arrest, in CC No.50984/2016 (Crime No.247/2014 of Byappanahalli Police Station) pending on the file of X Additional Chief Judicial Magistrate, Bangalore, subject to following conditions: (i) The petitioner shall voluntarily appear before the trial Court within 10 days from this day and execute a bail bond for a sum of Rs.1,00,000/- with one surety for the like-sum to the satisfaction of the trial Court. (ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly.

(iii) The petitioner shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
