ORAL ORDER This petition is filed invoking Section 439 of Cr.P.C./ 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS),
2023. The petitioner is accused of offences under Sections 341, 307, 504 and 506 read with Section 34 of Indian Penal Code.
2. It is not in dispute that the investigation is over and charge sheet is filed. The petitioner is in judicial custody since 10.02.2025.

Learned counsel appearing for the petitioner would submit that a false case is filed against the petitioner and he was not accused or convicted for any offence on an earlier occasion. It is also urged that the petitioner is ready to abide by any conditions for his release on bail.

4. Learned High Court Government Pleader would submit that the incident is witnessed by eye witnesses and the material placed on record would indicate that the petitioner is guilty of offences alleged.
5. The Court has considered the contentions raised at the bar and perused the records.
6. It is noticed that the petitioner was granted bail during investigation. After the charge sheet is filed, he did not appear before the trial Court and thereafter, the Court has issued Non-Bailable Warrant. Pursuant to the Warrant, he has been arrested and since then he is in judicial custody.
7. Since the charge sheet is already filed and he was granted bail earlier, the Court is of the view that the petitioner should be enlarged on bail, subject to certain conditions. Hence, the following:

ORDER
(i) The petition is allowed. (ii) Accused No.5/petitioner shall be released on bail subject to accused No.5/petitioner furnishing bail bond for a sum of Rs.1,00,000/- with two sureties for the like- sum to the satisfaction of the Trial Court. (iii) Accused No.5/petitioner shall undertake to appear before the Trial Court on every hearing and he shall co-operate with the trial. (iv) Accused No.5/petitioner shall not tamper with the evidence. Sd/- (ANANT RAMANATH HEGDE) JUDGE
