03/ 12.11.2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in connection with Chandwara P.S. Case No. 55 of 2025, registered for the offences under Sections 126(2), 115(2), 109(1), 118(1), 352, 351(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Koderma.

Learned counsel appearing for the petitioners submits that the petitioners and the informant side are family members and the scuffle took place due to earlier land dispute. He next submits that the allegations are made that Rojdeo Yadav @ Rajdev Kumar Yadaba has assaulted the informant by way of axe, pursuant to that injury has been received. He further submits that there are general and omnibus allegations against petitioner Nos. 1 and 3. He then submits that the petitioners are having no criminal antecedent and disclosure to that effect has been made in para-16 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations of assault are there.

Looking into the contents of the FIR, it transpires that there is direct allegation against petitioner No. 2 Rojdeo Yadav @ Rajdev Kumar Yadaba of assaulting the informant, causing injury to him, I am not inclined to grant anticipatory bail to petitioner No. 2 Rojdeo Yadav @ Rajdev Kumar Yadaba. Accordingly, his prayer for anticipatory bail is rejected.

So far as the petitioner Nos. 1 and 3 are concerned, there is general and omnibus allegations against them, I am inclined to grant anticipatory bail to the petitioner Nos. 1 and 3.

Accordingly, the petitioner Nos. 1 and 3, named above, are
directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty-five thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Koderma, in connection with Chandwara P.S. Case No. 55 of 2025, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
