05/ 02.12.2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Complaint Case No. 717 of 2025, registered for the offence under Sections 41 and 42 of the Indian Forest Act, pending in the court of learned C.J.M., Chatra.

Learned counsel appearing for the petitioner submits that the petitioner happened to be the owner of the truck in question and it has been alleged that the coal has been loaded on the said truck. He next submits that in the seizure list, the quantity of the coal has not been disclosed and further the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-12 of the petition.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of illegally loading of coal on the truck in question.

Considering that the petitioner is the owner of the truck and the quantity of the coal has not been disclosed in the seizure list and further the petitioner is having no criminal antecedent and disclosure to

that effect has been made in para-12 of the petition, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner, named above, shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty- five thousand), with two sureties of the like amount each, to the satisfaction of learned C.J.M., Chatra, in connection with Complaint Case No. 717 of 2025, subject to conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
