GP FOR HOME (AP) The Court made the following: 3 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.46451 OF 2018 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “….issue a writ, order or direction more particularly one in nature of Writ of Mandamus declaring the inaction on the part of the respondent No.3 in acting on the complaint, dated 10.12.2018 and registering the crime against the respondents No.4 to 7 as arbitrary, illegal, abdication of the statutory duty cast on him and violate the fundamental rights guaranteed to me under Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondent No. 2 and 3 to act on the compliant, dated 10.12.2018 submitted by me and take action against the respondents No.4 to 7 and pass…” 2. Heard Sri Chakravarthy P.V.S.K, learned counsel for the writ petitioner and learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home on written instructions would submit that no reports are received by the concerned police station from the petitioner with regard to alleged offence. 4. This Court earlier on 30.07.2025 ordered that the petitioner is at liberty to approach jurisdictional Magistrate for necessary redressal in the light of judgment of the Hon’ble Apex Court in the case of M.Subramaniam and Another, Appellants Vs. S.Janaki and Another, Respondents1. 5. It appears that the writ petitioner did not approach the Jurisdictional Magistrate so far for necessary redressal. 1 (2020 SCC Online SC 341) 4 6. Considering the above facts and circumstances, this Court is of the considered opinion that nothing remains for adjudication in the writ petition, and it can be closed at the stage of admission, without going into merits of the case, giving liberty to the petitioner to approach either jurisdictional Magistrate or concerned police in accordance with law, in the light of the above referred Judgment. 7. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
