Heard Sri Birendra Pratap Singh, learned counsel for the State/appellant and perused the record. 3. This appeal has been filed against the judgement and order dated 09.9.2010 passed by Special Judge S.C./S.T. Act, Gorakhpur in S.T. No. 55 of 2006, State vs. Surendra and others, by which the accused/respondents have been acquitted of the charges levelled against them. 4. On 19.1.2012 the following order was passed by another Bench of this Court: "The present government appeal is reported to be beyond time by 355 days. It was not explained, who was responsible for the delay and what action has been proposed against him. Learned AGA prays for and is granted two week's time to file supplementary affidavit explaining the delay in view of the aforesaid observation. List after two weeks before the appropriate Court." 5. Learned A.G.A. submits that despite his intimation no one has responded to his call and as such is unable to file the said affidavit. 6. This appeal is reported to be beyond time by 355 days. Proper explanation regarding delay in filing the present appeal has not been given. Even after more than 13 years supplementary affidavit as was prayed for by learned Versus Counsel for Appellant(s) : G.A. Counsel for Respondent(s) : State of U.P. .....Appellant(s) Surendra Singh And Others .....Respondent(s) counsel for the State/appellant has not been filed in the matter. 7. In view of the same, the application for condonation of delay in filing the appeal is dismissed. 8. The matter be consigned to the records. 9.
