JUSTICE SAMEER JAIN Order 18/11/2025 The nitty-gritty of the instant matter is that an embezzlement was committed in the jail premises, by one of the jail staff members, and there was an attempt to compound the offences by depositing the embezzlement amount. In compliance with the directions spelled out in order dated 06.11.2025, the Director General of Prisons, Rajasthan has marked appearance via VC. He has submitted that as soon as the matter came to his knowledge, he directed a comprehensive audit for the relevant period and has initiated an improved internal control mechanism. He further submitted that a detailed investigation is ongoing and that the concerned person has been arrested. (2 of 2) [CRLMB-14360/2025] Learned Public Prosecutor has submitted that the present application under Section 482 of BNSS is rendered infructuous as the applicant has already been arrested. In view of the statement of the learned Public Prosecutor, the instant bail application is dismissed as having become infructuous. However, this Court deems it appropriate to direct the jail authorities to devise and implement robust internal control and regular public audit mechanisms, to ensure that public funds allotted to the prison(s) are not defrauded.
