The present petition has been filed for the following reliefs:- 10.1 That the Hon’ble Court may kindly be pleased to call for entire records pertaining to the case of petitioner for kind perusal of this Hon’ble Cour. 10.2 That the Hon’ble Court may kindly be pleased to direct in the writ of mandamus to the respondent No.1 & 2 to give employment to the petitioner as per gazette notification dated 27/09/2013. 10.3 That the Hon’ble Court may kindly be pleased to direct the respondent No.1 & 2 to decide the pending representation (Annexure P-4). 10.4 Any other relief, which may be deemed, fit by this Hon’ble Court just and proper in the facts and circumstances of the case may also be provided in favour of the petitioner. 2. The grievance of the petitioner is that Respondents No.1 & 2 have acquired the land of the petitioner for the expansion of the Kusmunda Extension Project for excavation of coal Mining in the Village Amgaon, Khodri, Khairbhawna, Gevra and Churail in total of area 1050.593 hectare of land, however, despite that the SECL has not provided employment to the land losers. 3. Learned counsel for the petitioner contended that Respondents No.1 & 2 should give employment to the petitioners in view of the Gazette Notification dated 27th September, 2013, therefore, the respondents may be directed to give employment to the petitioner in lieu of acquisition of land. 3 / 3 4. Per contra, learned counsel for the Respondents oppose the submission made by learned counsel for the petitioner and would submit that actually no representation has been filed by the petitioner which would be evident from Annexure P/4 because it does not bear any seal or signature, therefore, it cannot be said that the petitioner has filed the representation and in absence of any representation made by the petitioner no cause of action is arising against the respondent authorities. 5. I have heard learned counsel for the parties and perused the documents. 6. Perusal of Annexure P/4, which is the representation of the petitioner dated 27/02/2025, would show that there is no receiving on the representation given by the petitioner to the General Manager, SECL, Kusmunda Area, Post Kusmunda Colliery Korba, District Korba, C.G. and the petitioner has not filed the copy of the Gazette Notification dated 27/09/2013, therefore, in such circumstances there is no cause of action arising against the Respondents No.1 & 2. Therefore, the petition is defective one. 7. Accordingly, the writ petition is dismissed. However, the petitioner is granted liberty to file a better constituted petition, if cause of action arises.
