The application is signed by the petitioner along with an affidavit annexed by the petitioner himself. 2. Presently, the election petition is at the stage of scrutiny. The petitioner sought for amendment of the election petition, which was allowed, but the amendment has not yet been carried out. No notice has been ordered or issued to the respondent. 3. I have perused the affidavit annexed to the application. 4. Therefore, I do not find any legal impediment to allow the application filed by the petitioner and grant leave to the petitioner to withdraw the election petition, as the - 3 - HC-KAR NC: 2025:KHC:46418 EP No. 5 of 2024 application is filed under Section 109 of the Representation of People Act, 1951 and its squarely comes under Section 109(1) of the Representation of People Act, 1951.
