1. By way of the present petition, the petitioner has prayed for the following reliefs:
“10.1 That, this Hon’ble Court may kindly be pleased to stay and quash mutation
order dated 26.09.2024 (Annexure P/1). 10.2 That, the Hon’ble Court may kindly be pleased to make any other order that may be deemed fit and just in the facts and circumstances of the case including awarding of the costs to the petitioners from the respondents.”
2. Learned counsel for the petitioner submits that the respondent no. 4 passed the order dated 26.09.2024 by which the mutation of house no. LIG-101 situated at C.G. Housing Board, Division Raipur, constructed at Arang has been transferred to the daughter-in-law of petitioner no. 2 without considering the objection of mother and the nominee sister.
3. Learned counsel for respondent no. 1 to 4 submits that on the basis of enquiry the respondent no. 4 has passed the mutation order.
4. I have heard learned counsel for the respective parties and perused the record with utmost circumspection.
5. Considering the facts and circumstances of the case, submissions of the
3 counsels, it is crystal clear from the records that after the death of Late R.K. Sahu a dispute arose between the private parties. Therefore, this is purely a civil dispute.
6. Accordingly, the present petition is dismissed with liberty to the petitioner to file civil suit before the competent court, if so desire. Sd/-
