BEFORE HONOURABLE MR. JUSTICE SOUMITRA SAIKIA ORDER 07.09.2026 Heard Ms. P Talukdar, learned counsel for the petitioner. The writ petition has been filed by the petitioner seeking a direction to finalise the provisional monthly pension as well as the DCRG in favour of the petitioner. The writ petitioner is the widow of Late Batish Ch. Boro who was serving as Assistant Teacher in Gomura Vidyanikatan High School. Subsequently, his services were regularized w.e.f 03.03.2008 and it was registered under the National Pension Scheme. The petitioner’s late husband however expired while in service on
12.02.2015. Pursuant to the demise of the writ petitioner’s late husband, the petitioner had approached the authorities to release the family pension as well as DCRG and other benefits. However, the same had not been granted inspite of the
Page No.# 3/3 petitioner approaching the authorities and filing the necessary documents. Pursuant to issuance of notice in the matter, an opportunity is being granted to the respondents to complete their instructions. Today when the matter is called up, the learned State counsel has placed before the Court the order dated 18.07.2026 issued by the Inspector of Schools whereby sanction was accorded for drawl of compassionate family pension and other allowances as per Rules w.e.f 14.01.2016 to 31.05.2032.
The PPAN No. 2008472700100437 and PRAN No. 111001233043 of the late husband of the petitioner are also reflected in the order. Considering the order dated 18.07.2026 granting the pensionary benefits to the writ petitioner, the Court considers it appropriate to close this writ petition directing the respondents to complete the process by release of all pensionary dues of the writ petitioner’s late husband to the petitioner in terms of the order dated 18.07.2026.
