IN THE HIGH COURT OF ORISSA AT CUTTACK
CONTC No. 3671 of 2025
Balabati Pradhan …. Petitioner
Mr. S. S. Patra, Advocate
-Versus-
Suryawanshi Mayur Vikas, Collector, Balasore and others …. Opposite Parties/Contemnors Ms. B. K. Sahu, AGA
CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 20.03.2026
06.
1. Heard learned counsel for the respective parties.
2. This Court by order dated 13th March, 2026 had
directed the State to take instructions on the reply affidavit of the petitioner. Today, Ms. Sahu, learned AGA appearing for the opposite parties/contemnors, in response to the reply affidavit, produced a copy of the letter received from opposite party No.2 (contemnor) and therein, it is mentioned that as per the report of the R.I. concerned, there is no vacant space of Government land available in front of the house of the petitioner to settle it in her favour as per the demand. Mr. Patra, learned counsel for the petitioner submits that the land has been acquired illegally by the Government without compensation. It is submitted that the petitioner is not inclined to accept compensation either. Considering the order in W.P.(C) No.38309 of 2023 to the effect that opposite party No.2 (contemnor) shall examine the
plea of the petitioner and to take a decision on the representation received from her and it has been disposed of in the meantime, it is concluded by the Court that there is compliance but since the petitioner is still aggrieved, she has liberty to challenge the action availing appropriate remedy under law.
3. Consequently, the contempt petition is disposed of with the proceeding hereby dropped.
4. Issue urgent certified copy as per rules.
