compensation, but the Tribunal had held that 50% has to be paid by the Insurance Company and 50% has to be paid by the owner of the vehicle. It is submitted that the claimants are entitled to recover the entire compensation amount from the Insurance Company and the Insurance Company can recover the same from the owner of the vehicle. It is further submitted that the deceased was earning an amount of Rs.60,000/- per month and the Tribunal had taken the income at an amount of Rs.13,000/- per month and it has to be taken at Rs.60,000/- per month.
5.
Learned counsel appearing for respondent No.2/ Insurance Company submits that the Tribunal had rightly held that the negligence is 50% on the driver of the lorry and 50% on the driver of the Innova car. It is submitted that there is no evidence with regard to the income and in fact the income that is taken is on the higher side i.e., Rs.13,000/- per month instead of Rs.11,000/- per month. In those circumstances, the claimants are not entitled for enhancement of the compensation. - 6 -

6. Having heard the learned counsels on either side, perused the material on record. First coming to the issue of composite negligence, as it is a case of composite negligence, both the parties are jointly and severally liable to pay the compensation to the claimants. In those circumstances, the Insurance Company shall pay the entire compensation amount and they can recover the 50% of the compensation from the owner of the Innova car. 7. Coming to the enhancement of the compensation, this Court had perused the award passed by the Tribunal. Though it is stated that he is earning an amount of Rs.60,000/- per month, except two documents, there is no evidence to substantiate the same. In these circumstances, this Court do not find any reasons to enhance the compensation amount. 8. Accordingly, the appeal of the claimants is partly allowed. i. The entire amount shall carry interest at 6% per annum from the date of petition till the date of realization. - 7 -
