ORDER:
This instant writ petition is filed by the petitioner seeking the following main prayer:-
“to issue an appropriate writ order or direction more particularly one in the nature of Writ of Mandamus declaring the office order No.PA/20(66)/17-RM:EG dated 16.08.2017 of the 2nd respondent to the extent of imposing another major penalty of deferment of annual increment for a period of two years with effect on future increments duly treating the period from the date of removal till the date of reinstatement as not on duty for the purpose of leave and increments, is arbitrary, unjust and contrary to Reg.21 of A.P.S.R.T.C. Employees (C.C.& A) Regulations, 1967 and contrary to law, discriminatory and in violation of Article 14 and 21 of the Constitution of India and set aside the same including the Removal Order dated 24.06.2017 and Appellate Order dated 17.07.2017 and consequently direct the respondents to refix the pay of the petitioner by adding the annual increment deferred and by treating the period from the date of suspension till the date of reinstatement as on duty for leave and increments will all consequential benefits, in the interest of justice and fair play and to pass such other order or orders…..”

When the matter came up for hearing, learned counsel for the petitioner draw the attention of this Court in respect of passing of orders in identical matter and the case is squarely covered with W.P.No.4146 of 2016 dated 28.03.2025, for which, learned counsel for the respondent has said no objection. 3
3. Hence, in view of the submission made by both the counsel, this Court is disposing of the present writ petition in the light of the orders passed by this Court in W.P.No.4146 of 2016. 4. Thus, by taking into consideration the above line of orders, coupled with the peculiar facts and circumstances of the present case on hand, this Court deems it appropriate to dispose of this writ petition by modifying the punishment imposed by the Appellate Authority to that of deferring the annual increment for a period of two years without effect on petitioner’s future increments only, without altering other heads. It is also made clear that the above modified punishment is without any monetary benefits. 5. Accordingly, with the above modification, the present writ petition is disposed of. There shall be no order as to costs. Pending miscellaneous applications, if any, shall stand closed.
