THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA CONTEMPT CASE NO: 2699/2017
ORDER: This contempt case is filed against the respondents for willful disobedience of the orders dated 14.06.2016 passed by this Court in W.P.No.26509 of 2015. Heard the learned counsel for the petitioner and the learned counsel for the respondents.
Learned counsel for the petitioner submits that this Court passed an order dated 14.06.2016 in W.P.No.26509 of 2015, which is as follows:
“For the aforesaid reasons, Writ Petition is disposed of, directing the 2nd respondent-Mandal Executive Magistrate, to enquire into the matter in M.C.No.786 of 2015 by giving complete opportunity to all the stake holders, in accordance with the provisions of Section 145 of Cr.P.C., and pass final orders in the matter, within a period of one month from the date of receipt of a copy of this Order. The amounts realized by way of sale as per the orders of this Court in W.P.M.P.No.43817 of 2015, dated 07.01.2016, shall be paid subject to the outcome of the subject proceedings in M.C.No.786 of 2015. It is also made clear that for settlement of their civil disputes, it is open for the parties to approach a competent Civil Court.”
Learned counsel for the respondents submits that as per the orders dated 14.06.2016 of this Court, the 1st respondent conducted enquiry and recorded the statements of both the parties on 02.09.2016 and passed the orders vide

M.C.No.786 of 2015 dated 03.09.2016 by modifying the extent of disputed property from Ac.12.90 cents to Ac.4.80 cents with the consent of both the parties. As such, the orders of this Court are complied with. Considering the submissions made by both the learned counsel, this Court is of the considered opinion that the respondents have complied with the orders of this Court. The respondent authorities have complied with the orders of this Court and further no Contempt Case is made out. Accordingly, the Contempt Case is closed, granting liberty to the petitioner to challenge the orders passed by the respondents vide M.C.No.786 of 2015 dated 03.09.2016 by initiating separate proceedings, if so advised. No order as to costs. Consequently, Miscellaneous Petitions, if any, pending in the contempt case shall stand closed. ________________________________ VENKATESWARLU NIMMAGADDA, J
