W.P.A. 21056 of 2023
Nilambar Das Versus State of West Bengal & Ors.
Mr. S. A. Ahmed
…for the petitioner.
Mr. Pantu Deb Roy, AGP Mr. Pannalal Bandopadhyay
…for the state.
Petitioner is aggrieved by the inaction of the police authorities as in spite of registration of Sankrail PS Case No. 380 of 2023, there has been no progress in the case and the private respondents are trying to encroach the petitioner’s property in spite of civil court’s decree and as such he is unable to enjoy peaceful possession of the property. Learned advocate for the State has submitted a report. Report reflects that on the last representation Sankrail Police Station Case No. 380 of 2023 was registered for investigation. In the said case charge sheet has been submitted before the jurisdictional court and the case presently is pending before the learned Judicial Magistrate, 4th Court, Howrah wherein the next date has been fixed on
10.07.2025.
2 So far as the other issues are concerned, petitioner has his remedy before the civil court. If an application is made before the jurisdictional civil court, the same be dealt with as expeditiously as possible by adhering to the provisions of law. Police authorities would ensure that there is no breach of the peace or tranquility at the locale because of the inimical relationship existing between the petitioner and the private respondents. With the aforesaid observations WPA 21056 of 2023 is disposed of. Report so submitted be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
