Learned counsel for the petitioner submits that issue involved in this writ petition is squarely covered by the decision of this Court in the case of Sri H.S. Shankaraiah Vs. Deputy Commissioner and Arbitrator (National Highway)1 (Sri H.S. Shankaraiah) and similar order be passed.

4. The petitioner claims to be the absolute owner of land bearing Sy.No.95/3, measuring 3 acres 20.04 guntas of Kodigepalli Village, Kyasamballi Hobli, K.G.F Taluk, Kolar District. Respondent No.2 has acquired a portion of the said land measuring 4598 square meters for the purpose of Bengaluru-Chennai express way and an award dated 31.01.2017 was passed by fixing compensation of `6,39,790/-. Feeling unsatisfied with the compensation, the petitioner filed an application before respondent No.1 on 07.09.2021 under Section 3(g)(5) of the National Highways Act, 1956 (“NH, Act” for short) seeking enhancement. Respondent No.1 rejected the application holding that it was filed beyond prescribed limitation of three years under Article 137 of the Limitation Act, 1963.
5. This Court in Sri H.S. Shankaraiah’s case held at paragraph No.7 as under:
“7. Learned counsel for the petitioner contends that the impugned order is illegal and perverse

since the NH Act does not prescribe any specific period of limitation for filing an application under Section 3G(5) of the NH Act. While Article 137 of the Act of 1963 may apply, the limitation of three years must be computed excluding the period covered by the Supreme Court's Suo Motu Writ Petition (c) No.3/2020 concerning the COVID-19 Pandemic. The Apex Court by its order dated 10.01.2022
directed that the period from 15.03.2020 till 28.02.2022 shall be excluded in computing limitation prescribed under all general and special laws. The relevant portion of the said
order reads as follows:
"It is further clarified that the period from 15.03.2020 till 28.02.2022 shall also stand excluded in computing the periods prescribed under Sections 23(4) and 29A of the Arbitration and Conciliation Act, 1996, Section 12A of the Commercial Courts Act, 2015 and provisos (b) and (c) of Section 138 of the Negotiable Instruments Act, 1881 and any other laws, which prescribe period(s) of limitation for instituting proceedings, outer limits (within which the Court Tribunal can condone delay) and or termination of proceedings."

6. Since the petitioner filed an application on 07.09.2021, which falls within COVID-19 exclusion period. The finding of respondent No.1 that the application was barred by limitation is unsustainable. Accordingly, the present petition is squarely covered by the decision of Sri H.S. Shankaraiah’s and this Court pass the following:
ORDER i. The writ petition is allowed. ii. The impugned order dated 05.01.2024 passed respondent No.1 (Annexure-A) is hereby quashed. iii. The matter is remitted back to respondent No.1 to reconsider the matter afresh on its merit and pass appropriate orders, in accordance with law, within a period of eight weeks from the date of receipt of the certified copy of this
order.
