The writ petition has filed seeking the following main prayer:-
“…..to declare the action of the 3rd Respondent in continuing the petitioner under suspension vide Lr.No.25/2017 dated 17.08.2017 as illegal, arbitrary, unconstitutinal void and contrary to the Rule 79 b of A P Education Act 1982 and set aside the same and consequently direct the Respondents to reinstate the petitioner into service with all consequential benefits by issuing a writ more in the nature of Writ of Mandamus or any other writ order or direction from this Honble Court….”
2. The sum and substance of the writ petition is that the petitioner challenged the suspension order dated 17.08.2017, passed by the 3rd respondent. 2
3. On 14.03.2018, this Court pleased to pass the following interim orders:-
“Heard the learned counsel for petitioner. Though notice is served on 1st respondent, there is no representation on behalf of 1st respondent. Since as per the provisions of Section 79(3) (b) of the A.P. Education Act, 1982, period of suspension pending enquiry cannot extend beyond 2 months unless extended, there shall be interim direction as prayed for.”
4. The above said interim orders are still subsisting
At the time of considering the matter, Sri M.N.N. Ravi Shankar, learned Assistant Government Pleader for School Education placed a copy of the written instructions dated 17.04.2025 received from the 3rd respondent, which reveals that the writ petitioner has been reinstated into service vide proceedings Rc.No.9775/C9/2017, dated 29.03.2018 as per the orders dated 14.03.2018, passed in W.P.M.P No.29578 of 2017. Consequently, the writ petitioner also joined the duty. 5. In view of the above subsequent events, the learned counsel for the petitioner also reported that no cause survives in the lis. 6. Recording the above said submissions of the respective counsels, the writ petition is closed. There shall be no order as to costs. As a sequel, all pending applications shall stand closed.
