4.
Learned counsel for the petitioner submits that a Co-ordinate Bench of this Court, vide order dated 24.01.2020, disposed of the SB Civil Miscellaneous Stay Application No.134/2020 while imposing certain conditions on the respondents, but the respondents have not adhered to the conditions so imposed by the Co-ordinate Bench of this Court. 6. Heard the submissions made at bar and considered the material available on record.
7. From the facts of the case, it is evident that against the
judgment and decree dated 23.12.2019, the respondents have preferred S.B. Civil First Appeal No. 59/2020, wherein conditional stay order was passed by the Co-ordinate Bench of this Court vide
order dated 24.01.2020, however, the said conditions were not complied with, therefore, the stay order was vacated. Thereafter,

The respondents filed a second stay application No.3704/2025 that came to be dismissed on 10.10.2025 as not pressed which makes it abundantly clear that there is no stay operating against the
judgment and decree dated 23.12.2019.
8. Further, from the order-sheet of the Executing Court, it is reflected that the execution proceeding is being delayed for one reason or other, despite the fact that there is no interim order by the Court.

order in Bhoj Raj Garg v. Goyal Education and Welfare Society & Ors., Special Leave Petition (C) Nos. 19654 of
2022.
75. In view of the aforesaid, we direct all the High Courts across the country to call for the necessary information from their respective district judiciary as regards the pendency of the execution petitions.
