SREENIVASA REDDY CRIMINAL PETITION NO.510 0F 2025 ORDER : The Criminal Petition, under Section 482 of the BNSS, is filed on behalf of the petitioners herein/Al and A2 to grant anticipatory bail in connection with Crime No.206 of 2022 of Ponnur Town Police Station, Guntur District, registered for the offences punishable under Sections 120B, 420, 465, 466, 467, 468, 471, 403 and 404 read with 34 lPC and Section 66-D of the lT Act. 2. Case of the prosecution is that on 04.08.2022 the defacto comp]ainant filed a report before the police stating that his wife/deceased informed him that she sold her own FIat No.13 in Raghavendra Nilayam Apartment, Brodipet, Guntur on 03.02.2022 and an amount of Rs.7,99,952.80/- was available in her bank account. On 30.07.2022, when the defacto complainant went to the house of his wife in Ponnur and asked the mother of his wife, she informed that his wife died due to ill-health on ll.03.2022 in Gothala Swamy Ashramam, Nidubrolu. When he made an enquiry -ln Gothala Swamy Ashramam, he came to know that Al to A3 admitted his wife in the said Ashramam on 04.03.2022 and on the same day, she went into coma, and when his wife was in coma, Al to A3 obtained her thumb impression on the stamp papers. 3. Heard. Perused the record. 4. A perusal of the material on record goes to show that the version of the defacto complainant is that he is the husband of the deceased and after the death of the deceased he succeeded to the property and sold away the property to the third party. Thereafter, T¥5Zfff3Z3Sj€ r I -y 2 the mother of the deceased sold the property to the petitioners on 26.02.2024. On perusal of the same, it can be inferred that there are rival claims between the parties for the property and each party is claiming he is the owner of the property and is entitled to alienate the property to others. The said facts squarely come within the purview of civil disputes. 5. Since the petitioners herein are bone f,'de purchasers, this Court is inclined to consider request of petitioners for grant of anticipatory bail. 6. Accordingly, in the event of their arrest, petitioners herein/Al and A2 shall be released on bail on each of them executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) each with two sureties each for the like sum each to the satisfaction of the arresting police officials, and also on condition that the petitioners shall make themselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. The petitioners shall appear before the Station House Officer concerned once in a week i.e. on every Sunday between 10.00 a.m. and 01.00 p.m., till filing of the charge sheet. 7.
