Sl.No. 40 Court No. 35 G.S.Das 12.09.2025 WPA 21344 of 2025 Aklima Begum -Vs- The State of West Bengal & Ors. Mr. Rafikul Islam Sardar Mr. Uttam Kumar Proadhan … for the Petitioner(s) Mr. Amitabrata Roy, ld. GP Mr. Dipanjan Datta, ld. Sr. Govt. Adv. Mr. Sayan Datta … for the State – Respondent(s) The petitioner is aggrieved by the inaction of the police authorities as she has been facing resistance from the private respondents. To that effect, information was furnished with the Officer- in-charge of Chanditala Police Station, but, no steps have been taken. Report submitted by the State reflects that already Chanditala P.S. Case No. 684 of 2025 dated 06.09.2025 has been registered for investigation. Having considered that TS 356 of 2017 and the Appeal, being WPA 12272 of 2024 along with CPAN 191 of 2025 are pending, I am of the view that as both the parties are before the different forums – be it, civil and criminal Court as well as writ court, so far as the rights relating to the land is concerned, the same would be considered by the appropriate forum. The police authorities would only focus on the criminal case which has been registered. With the aforesaid observations, WPA 21344 of 2025 is disposed of. Pending application(s), if any, is also disposed of. Report so submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. (Tirthankar Ghosh, J.)
