Neutral Citation No. - 2025:AHC:66340-DB Court No. - 21 Case :- WRIT - C No. - 10643 of 2025 Petitioner :- Malkhan, And 3 Others Respondent :- The Commissioner Of Police, Rdc, Raj Nagar, Ghaziabad Uttar Pradesh And 5 Others Counsel for Petitioner :- Mohd Haider Counsel for Respondent :- Manu Ghildyal,C.S.C.,Tejasvi Misra Hon'ble Manoj Kumar Gupta,J. Hon'ble Anish Kumar Gupta,J. 1. Prayer made in the writ petition is for issuing a writ of mandamus commanding respondent no. 4 to decide the representation of the petitioners dated 27.02.2025. In the said representation the petitioners have alleged that they have valid title over a part of Khasra No. 207 and they are being threatened of dispossession by respondent no. 6, who is developing a Hi-Tech City. 2. Sri Sudeep Harkauli, learned counsel appearing on behalf of respondent no. 6 submits that respondent no. 6 is claiming title over major part of plot no. 207 on the strength of sale deeds obtained from the land owners and over 3000 sq. mtrs. on basis of lease deed obtained from Ghaziabad Development Authority. He fairly admits that some part of plot no. 207 still belongs to private individuals. He submits that it is not clear from the averments made in the writ petition nor from the representation made as to over which part of plot no. 207 the petitioners are claiming title. 3. Having regard to the nature of controversy, we are not inclined to examine the same in exercise of writ jurisdiction. The writ petition is disposed of with direction to respondent no. 4 to decide the representation dated 27.02.2025 or any fresh representation, as may be made by the petitioners, within two weeks from today along with true attested copy of the instant order. 4. The decision would be taken after opportunity of hearing to the petitioners and respondents no. 5 and 6 within twelve weeks from the date of receipt of the representation. (Anish Kumar Gupta, J.)
