The petitioner claims to be a tenant under Respondent Nos. 5 and 6. Learned counsel appearing for the Calcutta Electric Supply Corporation Limited (CESC) submits that, following the application filed by the petitioner, an inspection was scheduled; however, due to resistance from Respondent Nos. 5 and 6, the inspection could not be conducted. Learned counsel for Respondent Nos. 5 and 6 appears and opposes the petitioner’s prayer. Learned counsel for the petitioner has produced a copy 2 of the judgment and decree dated March 30, 2007, passed by the Civil Judge (Junior Division), 2nd Court at Howrah, against the mother of Respondent Nos. 5 and 6. The decree granted a mandatory injunction directing the restoration of the petitioner’s electricity connection and water supply. It is noted that the said decree was affirmed on appeal. I am of the view that, as the petitioner is admittedly a tenant of Respondent Nos. 5 and 6, he is entitled to a separate electricity connection from CESC. Accordingly, this writ petition is disposed of with the following directions: CESC shall conduct a fresh inspection within two weeks from the date of this order. The officials of CESC shall be assisted by the local police station during the inspection. Based on the inspection report, CESC shall consider the petitioner’s application for connection within one week thereafter, subject to compliance with all requisite formalities by the petitioner. The petitioner shall bear any costs incurred for police assistance. With the foregoing directions, WPA 21254 of 2025 stands disposed of. 3 Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
