N SRIHARI (Standing Counsel for ZPP MPP and GRAM PANCHAYAT) The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the 2nd respondent in interfering of the civil disputes and threatening to demolish and insisting to vacate the prayer house/church the proposed construction of the RCM Church in an extent of Ac.0.10 cent in R.S.No.123/4, 5 and R.S.No.124/2 of Nagendrapuram (Gotlapadu) H/o.Nagidipalem Panchayat as illegal, irregular, arbitrary without jurisdiction and violative of the provisions of the Criminal Procedure 2 Code and also offends Articles 14, 21 and 300 A of Constitution of India and consequently direct the 2nd respondent not to interfere into the civil disputes without following due process of law.” 2. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, Police are not interfering with the civil disputes of the Petitioner. Hence, the petition may be disposed of. 3. Sri Mangena Sree Ramarao, learned counsel for the Petitioner would submit, recording the same, the petition may be disposed of. 4. Considering the submissions made, the Writ Petition is disposed of. Police are directed not to interfere in the civil disputes and the Petitioner is at liberty to work out his remedies before appropriate forum. There shall be no order as to costs.
