PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioners/A14 and A17, seeking regular bail, in Crime No.236 of 2024 of Prakash Nagar Police Station, East Godavarai distr'lCt. 2 J7
2. A case has been registered against the petitioners herein and others for the offences punishable under sectl'ons 126(2), 324(4), 262, 253,132,121(1),109(1), 309(4) and 351(2) read with 49 of the Bharatiya Nyaya sanhl'ta, 2023. 3.
Case of the prosecution, I'n brief, is that, as per the I'nStruCtiOnS Of the Inspector of police, JR Puram, srjkakulam district, the sub-Inspector of poll'ce, Laveru polI'Ce Station, srikakulam district, along with his staff, went to Bhjmavaram, west Godavari and caught hold of Rapaka prabhakar @ pratap Reddy, who I®S arrayed as accused in crl®me No.119` of 2024 of G. Sigadam poll'ce stall-On and a" are went to prakashnagar ps to enqul're about the other accused jn the saI'd Crl'me. WhI-le they were returning to srI-kakulam on the same day at about ll.30 pM while they were near croma shoppI'ng Mall, RTC complex road, Rajamahendravaram, some unknown persons obstructed and assaulted them with cricket bats and stI-CkS and also wI'th hands and damaged the vehI'CleS and snatched the case documents and robbed cash of Rs.10,000/-from the sl of Police and forcibly took away the vehl®cle keys and escaped from the place along wI'th Rapaka prabhakar @ pratap Reddy. 4. 5. A perusal of the material on record goes to show that basing on the confessl'onal statement of co-accused, the Petitioners here,I'n Were shown as accused in the present crime. Except the confessional statement of co-accused, there is no other material to connect the petitioners herein to the alleged crime. Petitioners herein were arrested on 17.12.2024 and since then they are languishing in J'aiI. Learned Assistant Public Prosecutor submitted that major portion of investigation has been completed. 6. In view of the aforesaid facts and circumstances of the case, thl's Court is inclined to grant bail to the petitioners/A14 and A17 on the followl'ng conditions. i) The petitioners/A14 and A17 shall be released on bail on their executing personal bonds for Rs.10,000/-(Rupees Ten Thousand only) each wl'th two sureties of the like sum each to the satisfaction of the learned ll Addl'tional JudicI'aI Magistrate of Fl'rst Class, Rajamahendravaram. ii) On release, the petitioners shall appear before the StatI'On House Officer concerned, once in a week i.e., on every Saturday between 10.00 am and o1.00 pm, till filing of the charge sheet. . 4 I.
