By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (“BNSS” for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 105 of 2025 registered with Shivaji Nagar Police Station, Kolhapur for the offences punishable under Sections 109, 115(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (“BNS” for short). 3. Applicant was arrested on 15th February 2025. Criminal Bail Application No. 83 of 2025 filed by the Applicant was rejected on Gitalaxmi 24-BA-1788-2025.doc 28th March 2025. 4. Mr. Tanveer Khan, learned A.P.P. for the State/Respondent submits that upon completion of investigation, the charge-sheet is filed before the learned Sessions Court, Ichalkaranji on 9th May 2025. 5. Mr. Saurabh Tandale, learned Advocate for the Applicant submits that there is now change in circumstance, in view of filing of the charge-sheet. He on instructions from the Applicant craves leave to withdraw the present Bail Application by seeking liberty to file a fresh Bail Application before the learned Trial Court in view of the change in circumstance. Liberty as prayed by the Applicant is granted. 6. In the event any fresh Bail Application is filed by the Applicant before the learned Trial Court, the same shall be considered on its own merits and in accordance with law. 7. In view of the above, Criminal Bail Application No. 1788 of 2025 is dismissed as withdrawn with liberty as prayed. [ASHWIN D.
