The petitioner is apprehending his arrest in connection with Jariyagarh PS Case No.36 of 2025, for offence registered under section 317(5) of BNS, 2023 and Sections 4 and 21 of Mines and Minerals (Development and Regulation) Act, 1957, pending in court of learned Chief Judicial Magistrate, Khunti. 3. Learned counsel for petitioner submits that the petitioner happened to be driver of the Hywa in question and allegation is made that illegally the sand in question has been loaded on the said vehicle. He further submits that the petitioner has complied notice under section 35(3) of BNSS, 2023. 4. Learned State counsel opposes prayer and submits that the petitioner happened to be the driver of the vehicle. 2025:JHHC:38607 2 5. Considering that the petitioner has complied the notice under section 35(3) of the BNSS, 2023, and in that view of the matter, the petitioner is hereby directed to surrender before the learned court within four weeks from today, and the learned court shall release the petitioner on such terms and conditions as well as the sureties, as the learned court may deem fit and proper. 6.
