1. Heard Ms. Madhunisha Singh, learned counsel for the petitioner. Also heard Mr. Shailendra Sharma, learned Panel Lawyer for the respondents/ State. 2. The petitioner has filed this petition praying for following relief:-
“A. That the Hon'ble High Court may kindly be pleased to allow this petition and Kindly be pleased to quash the chargesheet bearing no 108/2024 dated 17.05.2024 (Annexure P/1) under Section 377, 498a, and 34 of IPC in FIR No 101/2024 Dated. 05/04/2024 filed by O.P- Maro Thana- Nandghat, District-Bemetra Chhattisgarh Filed against the Petitioners B. That, this Hon'ble Court may kindly be pleased to quash order dated 30.05.2024 (Annexure P/2) taking cognizance of the Final Report No. 108/2024 dated 17.05.2024. C. That, this Hon'ble Court may kindly be pleased to quash order dated 04.10.2024 the framing of charge vide impugned order framing Charge under Section 498a 377 and 34 of the IPC and section 4 of Dowry
3 prohibition act for petitioner no 01 and under sections 498a and 34 and section 4 of Dowry prohibition act for petitioner no 02 to 04 dated 04.10.2024 (Annexure P/2)Colly. D. That, this Hon'ble Court may kindly be pleased to quash consequential criminal proceedings initiated in criminal case 10.
1108/2024 pending before Judicial Magistrate First Class Bemetra ,District- Bemetra Chhattisgarh against the petitioners for the offence under section 498a,377 and 34 of the IPC and section 4 of Dowry prohibition act for petitioner no 01 and under sections 498a and 34 of IPC and section 4 of Dowry prohibition act for petitioner no 02 to 04 in exercise of powers under section 528 of the BNSS, in the interest of Justice. E. Any other relief which this Hon'ble Court deems fit and proper may also kindly be granted to the Petitioners, in the interest of justice. An affidavit in support of is filed herewith.”

At the time of hearing, this Court has observed that the petitioner has filed the present petition without appropriate prayer which is defective one, therefore, we are not inclined to entertain the present petition with such a vague and sketchy prayer as the sections under which the offence is committed is not mentioned properly, counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file afresh with proper prayer. 4. Learned State counsel has no objection. 5. In view of the submissions made by learned counsel for the
4 petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for subject to depositing a sum of Rs. 2,000/- as cost by the petitioner in the Registry of this Court for wasting precious time fo the court and the said amount shall be transmitted to the Government Multi-Disabled Home, Village Pendri, District- Janjgir- Champa (C.G.). 6.
