The Court made the following order: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking regular bail, in Crime No.25 of 2024 of Donkarai Police Station, Alluri Sitharama Raju District. 2. A case has been registered against the petitioner herein and others for the offences punishable under Section 111 (2)(b) of `x-1 L` tS ca66Z3533irf'
I J/ the Bharatiya Nyaya Sanhita, 2023 (for short fthe BNS') and Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and psychotropic Substances Act, 1985 (for short fthe NDPS Act'). 3. Case of the prosecution, in brief, l's that, on 26.ll.2024, at about o4.00 pm, on credible information, the sub-Inspector of Police, Donkarai poll'ce station, along wI-th his Staff and mediators, rushed to the spot and found Al to A3 and A6 were in possession Of 23 Kgs of Ganja.
The contraband was seized under cover of a mediators report and Al to A3 and A6 were arrested. Al to A3 and A6 confessed about the l'nvolvement of other Accused Nos.4 and A5 in the present crime. 4. Heard. Perusedtherecord. 5. A perusal of the material on record goes to show that the Poll-ce, on credible information, arrested the accused and seized 23 Kgs of Ganja worth Rs.1,26,500/-on 26.ll.2024. Learned Assistant public Prosecutor submits that the petitioner herein was involved in as many as nine (9) other cases pertaining to the offences under lpc and BNS and insofar as the NDPS Act is concerned, thI'S iS the first case as against the petitioner herein. J7 charge sheet could not be filed for want of inventory. petitioner herein was, arrested on 26.ll.2024 and Since then he iS languishing in jail. 6. ln V-lew Of the aforesaid facts and Circumstances Of the case, this court is inclined to grant ba" to the petitioner herein/AI on the following conditions. i) The petitioner/Al shall be released On bail On his executing a per~sonal bond for Rs.10,000/- (Rupees Ten Thousand anly) With two Sur6t|les of the like Sum each tO the satisfaction of the learned I Addit'lOnal District and Sessions Judge, RajamahendraVaram. ii) on release, the petit'loner shall appear before the station House Officer COnCerned, Once in a Week i.e., On every Saturday between 10.co am and 01.00 pm, I-lll filing Of the Charge Sheet. 7.
