ORAL ORDER
This petition is filed seeking permission to permit the petitioner to leave India for the purpose of joining employment with the Royal Aircraft Maintenance Company, UAE in terms of the Employee contract at Annexure-G by relaxing condition No.(d) imposed on the petitioner vide order dated 23.09.2024.
2. The petitioner is facing criminal prosecution in C.C. No.107/2025 arising out of Crime No.0091/2024 for

the offences punishable under Sections 281 and 105 of the Bharatiya Nyaya Sanhita, 2023 and Section 185 of the Indian Motor Vehicles Act, 1988.
3. The learned Magistrate has enlarged the petitioner on bail; however, at clause (d) of the operative portion of the order, a condition has been imposed that the petitioner shall not leave India till disposal of the case without prior permission of the Trial Court.
4. Since the condition restraining the petitioner from leaving India without prior permission of the Trial Court has been imposed by the learned Magistrate, the proper remedy available to the petitioner is to seek relaxation of the said condition or to obtain permission from the Trial Court. It is also brought to the notice of this Court that such an application has already been filed before the learned Magistrate and is presently pending consideration.

In that view of the matter, this Court is of the opinion that the present petition is not maintainable and is accordingly liable to be dismissed. Accordingly, the petition stands dismissed.
