This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…pleased to issue any appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus to declare inaction of the respondents 3 to 5 in not registering FIR against the 5th to 8th Respondents in pursuance of Petitioner’s complaint dated 3/11/2018 as illegal, arbitrary, unconstitutional and violative of the guidelines of the Honourable Apex Court in P. Lalitha Kumari Vs. State of UP (2014 (2) SCC (1) and direct the respondents 3 to 5 to register FIR against the 6th to 8th Respondents in pursuance of Petitioner complaint dated 3/11/2018 pleased to pass…”
2. When the matter is taken up for hearing, learned Assistant Government Pleader for Home upon written instructions would submit that basing on the complaint of the petitioner, the Police conducted a preliminary enquiry. Both parties appeared before the Police and it was found that there are civil disputes between the parties. He would further submit that a case has been filed by the 8th respondent against the petitioner vide C.C.No.52 of 2018 on the file of Judicial Magistrate of First Class Court, Thamballepalle under NI Act. 3. Sri K.Venkata Subbaiah, learned counsel for the petitioner would submit that recording the same, the petition may be disposed of. 4. Recording the submissions made by the learned Assistant Government Pleader, the Writ Petition is disposed of. However, the petitioner is at liberty to work out his remedies before the appropriate forum. No order as to costs. 4
