Memo.No.18965 /PS-3-2002-2 dt.13.9.2003 and the judgement in WP No.10744/2005 as modified vide WPMP No 39470 of 2013, ultra vires and violative of Art 14, 16,19 and 21 of the Constitution of India and set aside the same to the extent of date of absorption and consequently direct the respondents to approve the appointment w.e.f. 12.12.2000 with all the benefits attached to the post and grant

ORDER:
The instant Writ Petition is filed by the Petitioner seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief:
“ ... to pass orders particularly one in the nature of writ of mandamus declaring the impugned orders of the 2nd respondent in Rc.No.4984/2017 dt.2.7.2018 and 28.8.2018 absorbing the petitioner into a new post at S.P.G.High School, Muthalapadu under the 4th respondent w.e.f.6.7.2018 as arbitrary, illegal, contrary to G.O.Ms.No.75 School Education (PS-2) dt.23.9.2002 and Govrt.

2. Learned counsel for the Petitioner would submit that the cause in this Writ Petition does not survive for adjudication and this Writ Petition has become infructuous. 3. Learned Government Pleader for School Education is in attendance. 4. In that view, the Writ Petition is dismissed as infructuous. No order as to costs.
