ORAL ORDER
1. Accused no.1 in S.C.No.88/2025 pending before the Court of II Addl. District & Sessions Judge, Kolar, arising out of Crime No.179/2024 registered by Nangli Police Station, Kolar District, for the offences punishable under Sections 80(2), 85, 3(5) of BNS, 2023, and Sections 3 & 4 of Dowry Prohibition Act, 1961, is before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.179/2024 was registered by Nangli Police Station, Kolar District, for the aforesaid offences against the petitioner and others based on the first information dated 21.12.2024 received from Praveen Kumar who is the brother of deceased Gangothri. During the course of investigation of the case, petitioner herein who was arrayed as accused no.1 in the FIR was arrested on 21.12.2024 and remanded to judicial custody. After completing investigation, charge sheet has been filed against the petitioner and his parents who are arrayed as accused nos.2 & 3 in the charge sheet. Petitioner is arrayed as accused no.1 in the charge sheet. His bail application filed

before the Trial Court in S.C.No.88/2025 was rejected on
18.06.2025.
Therefore, petitioner is before this Court. 4. Perusal of the material on record would go to show that the marriage of the petitioner with deceased Gangothri was solemnized about four years prior to the alleged date of incident. From the said wedlock, they have two minor daughters. In the first information, it is alleged that petitioner and his family members were not properly taking care of the deceased in her matrimonial house and it is under these circumstances, she had committed suicide in her matrimonial house on 20.12.2024 by hanging herself. After completing investigation, charge sheet has been filed in the present case against petitioner and his parents. 5. In the charge sheet, it is alleged that deceased had sold a cow without the knowledge of the petitioner and she had not given the sale proceeds to him, and therefore, he had abused and assaulted her on 20.12.2024. Deceased who got depressed because of the assault made by the petitioner, allegedly had committed suicide by hanging herself at about 5.30 p.m. on

6. Petitioner who has no criminal antecedents is in custody from 21.12.2024. He is required to take care of his two minor daughters and age old parents. The allegations found in the charge sheet is required to be proved in a full-fledged trial. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail is required to be answered affirmatively. Accordingly, the following order:
7. The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.88/2025 pending before the Court of II Addl.
District & Sessions Judge, Kolar, arising out of Crime No.179/2024 registered by Nangli Police Station, Kolar District, for the offences punishable under Sections 80(2), 85, 3(5) of BNS, 2023, and Sections 3 & 4 of Dowry Prohibition Act, 1961, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless

the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. Sd/- (S VISHWAJITH SHETTY) JUDGE
