JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by sole accused under Section 483 of BNSS praying to grant bail in Crime No.101/2025 of Sulibele Police Station registered for the offences under Section 76, 352, 351(2) of BNS and Sections 66(E), 67 and 67A of Information Technology Act. 2. Heard learned counsel for petitioner and learned Addl.SPP for respondent/State. 3. Learned counsel for the petitioner would contend that the offences alleged against the petitioner are not punishable either with death or imprisonment for life. The petitioner and the victim-CW1 were colleagues and there was difference between them and a false case came to be filed against the petitioner. The allegation that the petitioner has uploaded naked photos of the victim in - 3 - HC-KAR NC: 2025:KHC:42153 CRL.P No. 12812 of 2025 Instagram by creating account is a matter of trial. The charge sheet is filed and the petitioner is not required for custodial interrogation. With this, he prayed for allowing the petition. 4. Per contra, learned Additional SPP would contend that charge sheet material indicate that the petitioner who was in contact with the victim has got her naked photos and uploaded in Instagram by creating account and committed the alleged offences. If the petitioner is granted bail there are chances of threatening the victim and other prosecution witnesses. With this she prays for dismissal of the petition. 5. Having heard the learned counsel, the Court has perused the FIR, complaint, charge sheet and other materials placed on record. 6. On perusal of column 17 of the charge sheet the accusation against the petitioner is that he was in contact with the victim and they were colleagues in the office. The - 4 - HC-KAR NC: 2025:KHC:42153 CRL.P No. 12812 of 2025 petitioner stated to have created Instagram account and uploaded naked photo of the victim and committed alleged offences. As the charge sheet is filed, the petitioner is not required for custodial interrogation. The petitioner is in judicial custody since 27.07.2025. There are no criminal antecedents of the petitioner. The offences alleged against the petitioner are not punishable either with death or imprisonment for life. Considering the above aspect, the petitioner has made out case for grant of bail with conditions. In the result, the following: ORDER The petition is allowed. The petitioner is granted bail in Crime No.101/2025 of Sulibele Police Station subject to following conditions: (i) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with one surety for the - 5 - HC-KAR NC: 2025:KHC:42153 CRL.P No. 12812 of 2025 like-sum to the satisfaction of the trial Court. (ii) Petitioner shall not tamper with the prosecution witnesses either directly or indirectly. (iii) Petitioner shall attend the trial Court on all dates of hearing, unless exempted and co-operate for speedy disposal of the case.
