This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:

“.... a Writ of Mandamus declaring action of the respondents No. 1 to 3 in not investigating in to case in Cr.No.(FIR) 231 of 2018 of M.R. Palli Police Station, Tirupati UPD registered against the respondents No. 4 to 7 as illegal, arbitrary, unjust and violative of Art. 14 of the Constitution of India and consequently DIRECT the respondents police to investigate in to case in Cr.No. (FIR) 231 of 2018 of M.R. Palli Police Station, Tirupati UPD registered against the respondents No. 4 to 7 and take appropriate action in the case.”
2. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, after investigation the case was referred as “Civil in Nature”. Hence, no further orders are required in this matter and the petition may be disposed of. 3. For ready reference, the written instructions are extracted hereunder:
“It is submitted that, the petitioner i.e., T Raghuramaiah lodged a complaint before the 3rd respondent i.e., Station House Officer, M R Palli Police Station, Tirupati UPD Chittoor District. Basing on the complaint of the petitioner the 3rd respondent police registered the case vide Cr.No.231/2018 U/s.4447,427 r/w 34 IPC on dt: 01-08- 2018 against the unofficial respondents.
During the course of investigation the IO LW1 & 2. After detailed investigation the case was referred as "Civil In Nature" vide C.No.247/SDPO(W)-TPT, dt:17-11-2020.”
4. Sri Butta Vijaya Bhasker, learned counsel for the Petitioner would submit that recording the same the petition may be disposed of. 5. Considering the submissions made, the Writ Petition is disposed of. However, the Petitioner is at liberty to work out his remedies before appropriate forum in accordance with law. There shall be no order as to costs.
