Criminal Miscellaneous Bail Application No. 344/2025 Dashrath Singh S/o Guman Singh, Aged About 31 Years, R/o Moyakheda, Ps Bhawani Mandi, Dist. Jhalawar (At Present Confined In Sub-Jail Bhawani Mandi) ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Shafiqur Rahman Ms. Saroj Jat For Respondent(s) For Complainant : : Mr. Jaiprakash Tiwari, PP Mr. Sanjay Khedar HON’BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 07/10/2025
1. The petitioners have preferred these bail applications under Section 483 of BNSS in FIR No.94/2022 registered at Police Station Bhawanimandi, District-Jhalawar for offences under Sections 147, 148, 149, 341, 323, 302 and 307 of IPC. 2. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record. [2025:RJ-JP:40655] (2 of 3) [CRLMB-343/2025]
3. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in these cases. It is submitted that the co-accused-Ishwar Singh, against whom the allegation is of inflicting an injury on the vital part of the body, i.e., the head of the injured Dhull Singh, has already been enlarged on bail by a Coordinate Bench of this Hon’ble Court vide order dated 14.11.2024, along with another co-accused, Shyam Singh. The present petitioners are alleged to have caused injuries only on the non-vital parts of the body, namely the legs and hands. Another co-accused-Madan Singh, has also been granted bail by a Coordinate Bench of this Hon’ble Court vide order dated
25.07.2025. The case of the present petitioners stands on an equal footing with that of the aforesaid co-accused who have been granted bail. The petitioners have been in judicial custody since
18.02.2022. Out of 22 witnesses only six witnesses have been examined so far. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence on the ground of parity, the bail applications of the petitioners may be allowed. 4. Learned Public Prosecutor and counsel for the complainant have vehemently opposed the bail applications.
It is stated that due to the cumulative effect of the injury, the deceased Dhull Singh died, therefore, in such scenario, the petitioners are not entitled to be released on bail. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, especially on the ground of parity and without expressing
[2025:RJ-JP:40655] (3 of 3) [CRLMB-343/2025] any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 6. Accordingly, the bail applications under Section 483 B.N.S.S. are allowed and it is ordered that the petitioners-Meharban Singh S/o Pratap Singh and Dashrath Singh S/o Guman Singh shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each of them to the satisfaction of the learned trial court for their appearance before that Court on all the dates till conclusion of the trial.
