And 11 Others Counsel for Petitioner :- Dhiraj Singh,Satyam Kumar Jaiswal Counsel for Respondent :- Azad Rai,C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Heard learned counsel for the parties. The present writ petition has been filed with prayer to direct the authorities to remove illegal encroachment made by private- respondent nos.5 to 11 from the land of the forest department i.e. Arazi No.267 and 271 situated in Village Bandhawa (Benauri), Tehsil Bara, District Prayagraj. Taking cognizance of the matter, we invited instructions from the respondents on the previous occasion. Instructions have been obtained from Divisional Director, Social Forestry, Prayagraj, according to which the spot has been got inspected on 01.03.2025 and various encroachments have been found over two plots. It is also stated that encroachment has been made by the petitioner also. A complaint has been instituted under Section 26 of the Indian Forest Act. In view of instructions furnished by the respondents, we deem it appropriate to dispose of the present writ petition with directions upon the Divisional Forest Officer, Prayagraj to ensure that appropriate action against guilty persons are taken so as to ensure removal of encroachment from forest land after following the procedure prescribed in law. It goes without saying that if encroachment is done by the petitioner also, necessary action to restore forest land would be taken at the earliest by following procedure prescribed in law preferably within a period of four months.
