Dhakar, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 27/08/2025 On 28.07.2025, explanation was sought from the concerned judicial officer for not considering the directions passed in D.B. Criminal Revision Petition No.382/2014 : Manohar Lal Saini versus State of Rajasthan, decided on 02.12.2015. In pursuance thereof, explanation has been furnished by the concerned Judicial officer.
(2 of 2) [CRLMB-5905/2025] Same is taken on record. In para No.5, the Officer has given his explanation for not granting benefit him in accordance with the observation/ratio laid down in the case of Manohar Lal Saini (supra) but while deciding the bail application filed by the accused petitioners, the observation and the ratio laid down in the case of Manohar Lal Saini (supra) was not dealt with and considered. Hence, the approach and practice adopted by the Officer does not deserve to be appreciated. The explanation is not convincing. But this Court would not like to pass any remark or comment and restrict himself in doing so but at the same time, it is deemed appropriate to advise the officer concerned to become more cautious and take into consideration observations and ratio laid down by constitutional courts while discharging court work.
