GP FOR HOME (AP) The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring that the inaction on the part of Respondent No.2 in considering the Petitioners representation dated 26-8-2018 for the appointment of an independent and impartial investigating agency like the CB-CID (Crime Branch-Criminal Investigation Department) to investigate into Crime No. 75 of 2018 being currently investigated by the Respondent No.3 as being illegal, arbitrary and unlawful and, consequently, directing that the Crime No. 75 of 2018 on the file of Respondent No.3 be investigated by the CB- CID.” 2 2. Sri Venkat Challa, learned counsel for the Petitioner would submit that the Accused in the present crime died. 3. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, the Accused in Crime No.75 of 2018 on the file of III Town L&O Police Station, Kakinada, died and hence the petition may be disposed of. 4. For ready reference, the written instructions are extracted hereunder: “After completing the investigation Respondent No.03 filed the charge sheet against the accused on 28.10.2018 before the Hon'ble IV AJFCM Court, Kakinada. In this case accused died and the case was abated on 01.10.2019 vide PRC no 42/2019 by the Hon'ble IV AJFCM Court, Kakinada.” 5. Considering the submissions made, the Writ Petition is disposed of. There shall be no order as to costs.
