Inaocha, learned counsel for the petitioner, on instruction, submits that the matter may be dismissed as withdrawn with liberty to approach appropriate forum. [2] Mr. S. Biswajit, learned senior counsel assisted by Ms. Nikita, learned counsel for respondent No. 2, has no objection. [3] Learned counsel for respondent No. 2 submits that the petitioner approached this Court instead of approaching the State Consumer Commission against the impugned order passed by the District Consumer Forum in order to avoid payment of statutory 50% cost for filing the present appeal and prays that some exemplary cost be imposed against the petitioner. [4] This Court has seen tendency of filing writ petitions against the impugned order passed by the District Consumer Forum before this Court which is against the statutory law. In future, this Court will take serious view regarding this matter. [5] Recording the submissions made at the bar, writ petition is dismissed as withdrawn with liberty to approach appropriate forum with a nominal cost of Rs. 5,000/- to be deposited to the High Court Bar Association.
